How is mediation interpreting different from arbitration interpreting?

Arbitration produces a record and a binding decision, so the interpreting is built around testimony and evidentiary accuracy. Mediation is facilitative and confidential, nothing is sworn, and the goal is an agreement both sides will sign. Most of it happens in private caucus with the mediator moving between rooms. How does caucus and shuttle mediation work with an interpreter?

The interpreter moves with the party, not with the mediator, and carries that room's confidential positions without leaking them across the hall. That is the single most important discipline in mediation interpreting and it is why we assign interpreters who have done it before. If both parties need interpreters, we staff two, because one interpreter cannot serve both rooms without compromising the confidentiality the process depends on.

Can one interpreter cover a full-day mediation?

Yes, and continuity matters here because terminology and register should not shift between the morning joint session and the agreement signed that evening. For long sessions, or where simultaneous delivery runs for extended stretches, we recommend a second interpreter for relay so accuracy does not degrade in the hours when the deal is actually made. We raise that when we quote, not at 6pm.

Are your mediation interpreters court-certified?

For court-annexed mediation and mandatory settlement conferences, yes, and we confirm certification for that venue before the assignment. For private commercial mediation, certification is not always required, and we will tell you when a professionally credentialed interpreter with the right subject-matter background is the better match than a court certification that does not fit the dispute.

Is everything said in mediation confidential?

Yes. Mediation privilege is the reason parties speak freely, so our interpreters work under signed confidentiality covering both joint session and private caucus. Nothing from one room is repeated in another, including to us. Where a mediator or court requires a specific confidentiality undertaking, we sign theirs.

How far in advance should we book a mediation interpreter?

As soon as the date is set, especially for rare language pairs and for full-day sessions where we may need to schedule relay. We can often confirm same-week availability for the common pairs and accommodate a mediation that gets moved up.
